Terms of use

The agreement between you and Nomi for using the app, including subscriptions.

These terms are a contract between you and Teacake ("we", "us") for your use of the Nomi app and its related services. By using Nomi you agree to them. If you don't agree, please don't use the app. Our privacy policy explains how we handle your data.

What Nomi does

Nomi helps you learn and remember English words: a word each day, reviews timed to your memory, and short games. The definitions, pronunciations and examples are written and checked with care, but they're for learning and may sometimes be incomplete or wrong. If a word matters for something important, check it in a dictionary of record. The same goes for "Try it": its verdicts on your sentences come from an AI model, and they can be wrong too.

Your account

Nomi makes an account for you the first time you open it, so your progress can be backed up. You can link it to Sign in with Apple or Google. You're responsible for your device and your sign-in. You need to be at least 13 to use Nomi.

Free and Pro

Nomi is free to use, with daily limits shown in the app. Nomi Pro removes those limits and adds features such as Unravel's Freeplay, the memory curve and sentence checking in "Try it", which checks up to 30 sentences a day. The app always shows what each plan includes and its price before you buy.

• Subscriptions. Pro is offered yearly or monthly. The yearly plan may start with a free trial; the app shows how long before you start it, and we'll remind you before it ends. Unless you cancel at least 24 hours before a trial or billing period ends, the subscription renews automatically and the store charges your account.
• Lifetime. A one-off purchase that unlocks Pro for as long as we offer Nomi, without renewal.
• Where you pay. Purchases go through the store you installed from: Apple on your App Store account, or Google on your Google Play account. Manage or cancel a subscription in your App Store or Google Play settings. Deleting the app or your Nomi account doesn't cancel it.
• Refunds are handled by Apple or Google under their own policies.
• Price changes to a subscription only apply after notice from the store, as its rules require, and you can cancel before they take effect.
• Restore. If you change phones, restore your purchase from the paywall or Settings.

Our content

The word entries, example sentences, games, the Nomi character, sounds and design belong to us or to those who license them to us. We give you a personal, non-transferable licence to use them in the app for your own learning. Please don't copy, scrape or republish the word lists or other content. Quotations from public-domain works are credited where they appear.

Your content

The words you save and the text you scan or paste are yours. You give us only the permission we need to provide the app: storing and backing up your learning for you. You can delete it at any time.

Using it fairly

Don't use Nomi to break the law, don't reverse-engineer, disrupt or overload the service or get around its limits or purchases, and don't access it by automated means. We may suspend access for anyone who does.

Availability

We work to keep Nomi running and improving, but we can't promise it will always be available or error-free, and features may change. If we ever stop offering Nomi, we'll give you reasonable notice.

The legal bits

As far as the law allows, Nomi is provided "as is" without warranties. Nothing in these terms limits rights you have that can't lawfully be limited, including your statutory rights as a consumer, or our liability for death or personal injury caused by our negligence, or for fraud.

As far as the law allows, we're not liable for losses that weren't reasonably foreseeable, and our total liability to you is limited to what you paid us for Nomi in the 12 months before the claim.

Ending

You can stop using Nomi and delete your account whenever you like, in Settings → Account → Delete account & data. We may suspend or end access if you seriously or repeatedly break these terms.

Changes

We may update these terms. We'll change the date at the top and, for anything material, tell you in the app before it applies. If you keep using Nomi after that, the new terms apply.

If you got Nomi from the App Store

• These terms are between you and us, not Apple. We, not Apple, are responsible for Nomi and its content, its maintenance and support, and any claims about it, including product liability, legal or regulatory compliance and intellectual property claims.
• Your licence is to use Nomi on Apple devices you own or control, as the App Store's Usage Rules allow.
• If Nomi fails to meet a warranty that applies by law, you may tell Apple, and Apple will refund the price you paid for it. Apple has no other warranty obligation for Nomi.
• You confirm you're not in a country under a US government embargo or on a US government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Governing law

These terms are governed by the laws of England and Wales, and its courts have jurisdiction. If you live elsewhere in the UK or in the EU, you also keep the protection of your local consumer law and can bring a claim in your local courts.
